NYC Department of Housing Preservation and Development (HPD) Violations are issued to properties that violate housing codes. Possible infarctions range from damaged, broken or malfunctioning installations, leaks, hygiene hazards and infestations and other problems that render a property unsafe, unhygienic or hazardous.
If your property is reported or found to be in violation of any housing codes an inspector will issue you with a Notice of Violation (NOV), which you’ll have to correct and clear within the set time-frame. Failure to comply can result in fines and legal action.
See the HPD violation classes, timeframe allowed to clear and types of penalties issued for non-compliance:
Class | Timeframe for correction | Penalties |
C – Immediately Hazardous | 24 hours or five days. There are two exceptions: lead and window guard corrections must be corrected within 21 days, but heating and hot water violations require immediate correction. | The penalty for not immediately correcting heat and hot water issues is $250 per day. This is ERP eligible. |
B – Hazardous | 30 days or 5 days for correction | Civil penalties and litigation |
B – Hazardous – Order to Correct | Differs – immediately to months | Civil penalties and municipal litigation |
A – Non-Hazardous | 90 days or 14 days | Fines and civil lawsuits. |
